Before Bill Gates, no one had a personal computer!   One man single handedly revolutionized the world with a dream…his dream was that every home would have a computer!  His dream was to provide value to every single household in the world!

Even after Bill Gates created such an incredible tool, that gave rise to the Internet, Easy Online access & E-Commerce; it STILL amazes me just how many people refuse, are afraid and/or have not taken advantage of the power of the computer and the Internet! You see people buy because:

i)    they know you,
ii)    they trust you
iii)   they believe that you have the solution the problem which the face and
iv)   for status

People don’t buy a product, nor do they buy a feature and the benefits are as they are decided upon by the story they tell themselves.   Your juice drink mwy help me loose weight.  But the story I am telling myself is that I am going to look sexy, finally that size 0 pair of jeans that I have seen on display for a year will be mine.  I am going to get hit on by men….you get the picture?  So if your pitch is not in line with my story…

How does all this fit into social media and social marketing?  Simple, you are building relational capital, by depositing in the bank of getting to know you, getting to know all about you!  And you are not only doing it with one person, no you are reaching out to many in one shot!

There are people on these sites that follow you, there are those that interact with you and those that want to see what you are about.  The cool thing about social outlets is that you are King and Queen of your own little internet real estate  King/Queendom!

Social media and social marketing is all about building that relational capital that gives you the all access pass to make your direct sales pitches to those who are ready, able and willing to hear what you have to say, and have the money to spend on what you have to sell.  Do not under-estimate the power of relational capital!

Next Generation Solutions for Online Sales Tax Compliance

Conversations with CEO’s CFO’s and any other c-level executive all indicate that these people are aware of sales & use tax issues that face their company, how difficult it is to comply, and has heard horror stories of audits, fines an penalties.

A survey of CFOs of small companies found that they spend, on average, at least 2 hours per sales tax return, per filing period. This number increases dramatically as the size of the company grows and revenue increases putting a greater burdon on any existing Online Sales Tax Solution.

This presupposes that they have good First Generation Solutions. Even with good First Generation Solutions in place, companies of all sizes spend many employee work hours in making sure that data is processed accurately, and transferred from one solution to another. A survey of small business managers found that they spend a couple of hours a day in transferring transaction and deposit data into their financial systems.

Larger companies were found to have many FTE’s dedicated to these functions. This data processing is necessary to address the back end functions of tax compliance – reporting, filing and auditing.

This high level of involvement, activity and knowledge is a strong indicator that something is wrong with the system. Are these people concerned with how authorization is processed by the financial institutions?; do they even know who all the players are in a typical transaction authorization process? No! and neither should they. Business executives should have to focus on building their business, and not on figuring out their response to the state tax auditor, explaining why a software developer does not know why a business must distinguish between a customer who purchased their doughnut at the counter, or ordered it while sitting at a table. Nor should they be treated as common thieves because they paid the correct taxes, just to the wrong county.

Recently, Next Generation Solutions have started to emerge into the market. The goal of Next Generation tax compliance solutions is to remove the pain typically associated with tax compliance, and, as a single source, provide for a single solution that addresses all the elements required for compliance. Next Generation Solution are deigned to automate processing of repetitive and time consuming tasks, and eliminating data and system gaps. This is a long winded way of stating that Next Generation Solutions provide for a seamless solution, which removes the entire burden of compliance from the retailer. By using a Next Generation solution, the retailer should be reassured that all their needs to address compliance are being taken care of, and they can focus upon their main goal, that of generating business.

The importance of Next Generation Solutions is best understood in light of the sense of complacency companies are lulled into when, as modern businesses, they use technologies to help management work more efficiently. Management tends to set a goal of ‘figuring taxes on transactions, and these First Generation Solutions achieved that goal. Management mistakenly assumed that using some form of tax solution achieves the goal of accuracy and efficiency. The availability and use of First Generation Tax Solutions tends to lull the business owner to believe that they have taken sufficient steps to maximize efficiencies and reduce liabilities.

In fact, tax auditors will not forgive a retailer for incorrect taxes calculated and paid, even if a reliable First Generation Solution was in use and relied upon. First Generation Solutions that generate tax forms, means that these forms need to be printed, reviewed, signed, inserted into an envelope, and mailed – in a timely manner. In addition to these hard costs, there are soft costs, which are more difficult to quantify. Forms engines might save some time by eliminating manual entries, however they do not save time over fully automated systems. For example, printed forms require higher levels of review maintenance and human intervention, to distribute, complete, physically manage, and store. The information in the form has limited access and visibility – limited to those individuals with actual access to the physical document. A Next Generation Solution should perform all of these tasks electronically and automatically. By automatically generating and performing an e-filing on behalf of the retailer, and storing the form in information systems readily available to the retailer, the Next Generation overcomes all those deficiencies associated with printed forms. The retailer need not be concerned that they have to activate the function enough time in advance to accommodate internal review and approval processes as well as postal delivery delays.

Printed Forms also do not indicate incorrect or incomplete data until physically reviewed. More concerning is that printed forms can be modified or changed – erroneously or intentionally, so that even if the form
is generated electronically

from a First Generation Solution, there is no guarantee that it will not be changed, and filed with the incorrect data. More concerning – that the correct return be filed with the incorrect agency, or the incorrect form will be filed – any of which might automatically trigger an audit. Electronic forms of Next Generation Solutions have built-in, auditable, internal rules of logic that prevent these types of errors and events from occurring. In effect, the systems receive all data directly from the transaction engine and transaction tracking engine, assuring the use of only transaction data, without external intervention, and that it is filed on time, to the correct recipient. While Next Generation Solutions will allow manual bypasses, these are more difficult to implement, and will always record and indicate not only what change was made, but by whom, and when.

A reproducible, auditable trail is the true differentiator between First Generation Form Filing tax solutions and those of fully automated Next Generation Tax Solutions.

Next Generation Sales Tax Solutions are the true sales and use tax compliance engines. The ability to determine the accurate tax rate in real time, factoring complex issues such as transaction nexus – where the transaction takes place, and taxability of the given product on a line by line item basis in that given nexus, is but one of the issues the engine needs to address. Another point of complexity is the ability to provide transparent, valid audit trails, providing documentation for each and every decision pertaining to the transaction made at any given point of time during the life-cycle of the transaction. The Next Generation Tax Solution provides a unified, single point of access, data-set that seamlessly integrates with all tax calculation, collection and payment modules, rather than requiring different audit trails for each of these steps, leaving to the auditor the act of reconciling these different trails, hoping that the benevolence of the auditor will lead to the desired results.

Next Generation Solutions should focus upon flexibility, maintainability; integration and reliability. Performing only two or three of the functions associated with tax compliance, while admirable and more advanced than what First Generation Solutions typically provide, will still not achieve the goals of the Next Generation Solution. The solution needs to perform all four of the functions under one package. The Next Generation Solution should be flexible enough that it allows for adaptability across different systems, allowing to address many different needs of the retailers.

In sum, the perfect Next Generation Solution would be (i) hooked straight into your transaction engine; (ii) provide the information necessary to assure that the correct tax is being calculated; (iii) save the transaction and tax data for further reference; (iv) be hooked into systems that will allow it to track the transaction through its life cycle; so that (v) any changes made to the transaction are reflected in the system; (vi) on a periodic basis as may be determined by statutes and regulations – compile the data necessary for filing; (vii) generate a return and report necessary for complying with statutory filing requirements; (viii) make the return available for review and approval by the retailer; (viii) file the return automatically and electronically straight into the systems of the state taxing agencies on the required date, helping the retailer avoid fines, penalties and interest associated with late filing; (ix) obtain from the retailer funds necessary for payment of tax proceeds; and (x) pay the taxes owing on a timely basis, applying electronic funds transfer methods to assure timely payment at the last possible moment without incurring penalties for late payment.

How to Use your Sem Campaign as a Long Term Sales Tool

The common misconception is that once the Search Engine Marketing (SEM) campaign is set up it can run itself. Even if your campaign is going great in the first month, you need to develop and fine-tune all campaign elements over the next 4-5 months. We at Trendhaus know that the longer you run SEM campaigns and “tweak” them, the more successful they become (for the same amounts of media budget). So, over the next six months, invest some time in your campaign performance. Follow these steps consistently and turn your SEM campaign into a long term sales engine!

Insert your tracking code

If you haven’t already inserted a conversion tracking code in the trial period, now is the time to insert it! Decide what you want people to ultimately do on your site i.e. purchase online, enquire or sign up and then place the code behind this ‘goal’ HTML page. The code will then track exactly how many purchases, enquiries or sign ups occurred as a result of your SEM campaign. You can then filter these results to see which keywords and text ads convert for you and really generate sales.

Use analytics and reporting tools

Google offers an analytics tool which allows users to learn more about who their visitors are, where they come from and how they interact on your site. The analytics function gives statistics on not only your SEM campaigns but other marketing initiatives as well so you can compare what is working for you. Other search engines also offer reporting tools which return important data on the effectiveness of your text ads and keywords. Regularly running these reporting tools will enable you to write better text ads and strengthen your marketing activities.

Pause ineffective keywords

Three months into the campaign, you should analyze the performance of you various key words and pause words which are not performing in regards to clicks and conversion data. We have clients who run their entire campaign with 10 key words only. These “golden nugget” words generate significant amounts of new client leads and/or online sales for them. Pausing ‘ineffective’ words will enable you to allocate your budget more effectively to better performing words.

Amend text ads for relevancy

Relevancy is a big thing in search engine marketing. There is nothing worse than seeing an ad that does not speak to the end consumer. For example: a business that is advertising their services in purely functional terms will run the risk of performing poorly, simply due to inappropriate copy writing for the web. If copy writing isn’t your strength outsource this part of your campaign to a specialist. It can make a world of difference to your campaign performance and in the end to your sales.

Also, amend text ads for location and keyword relevancy. Putting the suburb in the title will help deter wasteful clicks and save budget. For example: if a user is searching for a service in “Cronulla” and your ad shows with “Sydney CBD” in the title, they are less likely to click on it as it is not relevant to them. This increases your click through rate and saves the budget for people that are looking for products or services in your location.

Bidding strategy

Imagine the search engine market as something like the stock exchange. Competitors are constantly entering and exiting the market, driving the ‘market price’ for popular key words up and sometimes down. If you don’t consistently monitor and amend your bids you will soon find yourself on page three of the sponsored links. Coupled with the so-called ‘quality score’ for your text ads, search engines pretty much place the highest bidder for a particular keyword on position one. Understandably, this is where everyone wants to be because you will get the most traffic to your website. However, you have to remember that just like the stock exchange there are small and large players in SEM. Some companies have a lot of budget to spend when you may not. Be smart with your bidding! Don’t bid $10 on one word when you only have a daily budget of $30. In this case you should either reconsider your budget or look for another, more cost-effective type of marketing for your business.

Monitor best click days

After running your campaign for at least four months, you will begin to see clear trends in click patterns. Determine the days in which your campaign receives the most clicks as well as conversions. After four months, many of my clients move the budget from the least performing days and shift it to the best performing days only. Start off by eliminating one day and then over time you can refine your campaign in a way that will enable you to forecast results.

The one thing I have learnt about search engine marketing is that it’s not rocket science. However, it is time consuming and it needs 100% dedication. You need to allocate at least 3-4 hours per week to refine and analyze your campaign to make it work for you. Understandably, for anybody trying to run a business, 3-5 hours a week is a big ask especially when business is booming from the SEM campaign. If you cannot dedicate this time away from your business, sometimes it is best to enlist the help of a good agency or dedicated professional. That way, you can focus on your core business and let the experts do what they are best at – generating leads and sales for you.

The “Amazon tax” upheld in New York, enabling state taxation of web sales

Introduction

 

In a case that has all major online retailers nervous, a Manhattan court upheld a new state tax law that requires many out of state retailers to collect state sales tax on purchases by New York residents in Amazon.com LLC v. New York State Dept. of Taxation and Finance, ___ N.Y.S. 2d ___, 2009 WL 69336 (N.Y. Sup. 2009). Online giant Amazon.com challenged the law on constitutional grounds, but the New York Supreme Court judge found that Amazon did “not come close” to demonstrating unconstitutionality of the law.

 

Background

 

In 1992, the U.S. Supreme Court exempted out-of-state retailers from collecting sales tax in out-of-state transactions, i.e. where they sold goods to residents of a state where the retailer had no physical presence such as a store, office, or warehouse. Quill Corp. v. North Dakota, 504 U.S. 298 (1992). Although Quill dealt with a mail order company, the ruling has since been relied upon by a growing number of remote online sellers.

 

In April 2008, New York sought to overcome the Quill decision when it approved a new tax as part of its 2008-09 state budget. New York Tax Law section 1101(b)(8)(vi)contains a “Commission-Agreement” provision  requiring out-of-state online retailers to collect New York state sales tax if the retailer uses independent contractors or other New York residents to solicit sales in excess of $10,000 from New York residents.

 

The law had an immediate impact on large online retailers like Seattle-based Amazon.com, which previously did not have to collect sales tax in New York because they did not have a physical presence in the state. However, Amazon and many other retailers have affiliate linking programs that enable other websites to maintain a link to the online retailer’s site for incentives. Under Amazon’s affiliate program, which Amazon considers a marketing arrangement, when a customer links to Amazon.com from the affiliate website, that affiliate receives a  commission on the customer’s purchases. Amazon has “thousands” of these affiliates in New York, though the program reportedly accounts for less than 1.5% of Amazon’s total New York sales revenue.

 

New York tax officials contended that Amazon.com’s affiliate program makes it subject to the commission-agreement provision of the new tax law, forcing Amazon to collect sales tax on transactions with New York residents. Indeed, state officials referred to the tax as the “Amazon tax.”

 

Amazon filedsuit on April 25, 2008, alleging that the Commission-Agreement provision’s inconsistency with Quill   violates the Commerce Clause, the Equal Protection clause, and Amazon’s right to due process under the U.S. Constitution.  Judge Eileen Bransten, writing for the Supreme Court of the State of New York, dismissed the lawsuit upon defendants’ motion in Amazon.com LLC v. New York State Dept. of Taxation and Finance, ___ N.Y.S. 2d ___, 2009 WL 69336 (N.Y. Sup. 2009).

 

Amazon’s Constitutional Challenges to the Tax Fail

 

Amazon made three Constitutional challenges to the “Amazon tax.” First, Amazon contended that the new tax violated the Commerce Clause of the U.S. Constitution because it imposed a tax obligation on an out-of-state seller who lacked a “substantial nexus” with New York. States may require a retailer to collect state tax if the “tax is applied to an activity with a substantial nexus with the taxing State, is fairly apportioned, does not discriminate against interstate commerce, and is fairly related to the services provided by the State.” Complete Auto Transit Inc. v. Brady, 430 U.S. 274, 279 (1977).

 

The court pointed out that the “substantial nexus” test only requires the “slightest” physical presence, which can be imputed to the retailer through activities performed in the taxing state by the people or entities acting on the retailer’s behalf. Amazon, 2009 WL 69336, *3. Based on this standard, the court found that “(t)he Commission-Agreement Provision is carefully crafted to ensure that there is a sufficient basis for requiring collection of New York taxes and, if such a basis does not exist, it gives the seller an out… a tax-collection obligation will only be imposed based on an out-of-state seller’s conscious decision to contract with in-state residents who collectively refer more than $10,000 of New York based business.” Amazon, 2009 WL 69336, *4.

 

In making its due process claim, Amazon claimed that the tax law was unconstitutionally vague, because it could be interpreted to apply to non-Internet out-of-state retailers that buy ads in New York-based print media. But the court found otherwise, stating: “the statute’s applicability upon entry into an agreement with an in-state resident for a commission ‘or other consideration’ based on direct referral of New York customers or ‘indirect’ referrals is not so vague and standardless as to leave the public uncertain about its reach.” Amazon, 2009 WL 69336, *7.

 

Finally, Amazon claimed that the law violated the Equal Protection Clauses of both the U.S. and New York constitutions because the statute was enacted specifically to collect taxes from Amazon. However, the court noted that Amazon’s complaint contained no assertion that the State has actually treated it differently from other similarly situated retailers. Amazon, 2009 WL 69336, *7.

 

The Impact of the Amazon Tax

 

It is expected that Amazon will appeal this decision. In the meantime, online retailers have only two choices regarding New York sales tax – either they register with the state and collect the tax , which Amazon has chosen to do, or they cut off all ties with New York affiliates in order to avoid collecting the tax . The latter course, which Overstock.com has pursued, arguably puts a damper on e-commerce, as many of the affiliates are web start-ups that rely in part on the financial boost from these programs.

 

More importantly, this may put the online retail industry on a burdensome slippery slope. In reaching its decision in Quill Corp. v. North Dakota, the Supreme Court discussed the crushing burden that it would place on interstate commerce if remote sellers had to comply with the separate sales and use tax provisions in every location in which it conducted transactions. There are more than 6200 separate sales tax jurisdictions and more than 4400 separate use tax jurisdictions. If a significant number of those implemented a statute similar to New York’s, and if that statute were upheld on similar grounds, it would completely undermine the rationale of the Quill decision. The burden of trying to comply with each of those various jurisdictions may be more than a reasonable online retailer can handle.

Rhode Island has the nations highest unemployment rate, because the Rhode Island government has not created an environment that is business friendly,  Little Rhody has lost more jobs that ever before.

This can be a tough situation for out of work Rhode Island sales and marketing people, as they are mainly 1099 employees and don’t have unemployment insurance or other benefits. If they do have benefits, they pay dearly for them out of pocket.

There are people making a lot of cash on opportunities in this downturn. Why can’t you? There are money making opportunities everywhere, including Rhode Island. You just need to know how to spot them.

You do not need even need a high school diploma to join.

Everyone helps each other as a community. If you have a problem just post it in the forum. You will have people offering assistance that are experts. Some make 5k a day and are there to help guide you to success.

I just wanted to let all of my fellow Rhode Islanders know, that you can make awesome money from home, if you have the tools and the knowledge. I didn’t have any experience at all. It took about 8 weeks to mold me into a pro at WAU
